Well this is an interesting development. Let's play videos are a giant source of entertainment for people, revenue for it's creators, and free marketing for the studios. This change will make it so that the revenue from the creator, who depends on it as a first or maybe second source of income is gone to Nintendo instead.

I wholeheartedly expect Nintendo to take it back after a week, when every single let's play channel stops showing their games.

This doesn't sound at all like what you made it out to be before. I'm not surprised by the legal stance on this, just that Nintendo is the company doing it. If your own 'interpretation' of copyrighted material gave you the right to use intellectual property as you see fit, then Mystery Science Theater 3000 shouldn't have had to ask for permission to use the library of old movies that they did.

Even taking that into consideration, there is still some wiggle room. YouTube has made a point of saying that if game footage is accompanied by nonstop commentary, then it's permissible as an original work. Someone simply putting up a complete play-through of a game is a legal gray area and you know it. This kind of legal tug of war is exactly what pundits predicted when YouTube first launched. The situation is so screwed up that I'm finding it hard to support either side wholeheartedly.

If there were ever to be a battle between Nintendo and Youtube (or really anyone against Youtube for that matter), Nintendo would be crushed .... Google has so much money I feel like sometimes they're just looking for things to throw it at

But on a more related note this really doesn't surprise me at all. I don't think Nintendo realizes just how much this free advertising is probably helping their bottom line. Heck I hardly ever buy games anymore without first watching a few reviews/gameplay videos to see what it's all about.

For comparison purposes: Youtube made the same offer to Mojang (makers of Minecraft), and they said no way.
