Yea i'd say get a new cd drive, you can get a nocd patch off megagames.com until then, i've gone through about 2 cd drives in the last two years.

I'd go for torrent if your wanting full albums, emule surely doesn't give me any spyware, but i got a suped up version off bloody tom kid, and limewire is ok for single songs.
